Kirkbymoorside 'Wrong Vote' Development Heads to Court

A High Court battle looms after a councillor pressed the wrong button and granted planning permission to a development on Kirkbymoorside.

Conservative David Cussons voted to allow 210 new homes and 50 new flats to be built in Kirkbymoorside, but couldn't change his vote despite saying it was a mistake.

Now two Kirkbymoorside locals, William Shaw and Brian Hewitt, have won permission to challenge the decision to grant planning permission for the development in the High Court.

If they win the judicial review of the planning decision, the proposals would have to be looked at again by Ryedale Council's planning committee.

Ryedale Council says it won't contest the judicial review proceedings but developers Gladman Developments will do.

Separately, Gladman Developments, who are behind the development have submitted a new proposal to build homes on the land, that case is set to be examined in the New Year.
