Developers Gladman Developments say their fight to build 225 new homes in Kirkbymoorside will still go ahead.
That's despite Gladman Developments abandoning plans to take Ryedale Council to court - saying not enough houses would be built in the area.
A High Court challenge is set to take place to the original plans which were approved after a councillor voted in favour by accident.
Councillor John Raper, Chairman of the Ryedale District Council Planning Committee says:
"This very good news is a real credit to the efforts of the planning team at Ryedale District Council and I offer my congratulations to the team for the hard work they have put into this."
"Ryedale is one of only a handful of councils in the country that have an up to date local plan that is a fully compliant with the NPPF."
"I am delighted."
